Do i need to list expunged records on my nrotc application?

I received a dui along with minor possession my sopre year. however, I attended pti and got my records expunged. I never got convicted. and my lawyer said that i wouldnt have to answer yes to getting arrested. however, im scared that if i dont say yes when the application aks if i have been arrested or convicted and they do my background check, then i will be disqualified. i am scared that if i answer yes, then they wont even consider me...what to do what to do... i have impressive credentials and i believe i have a wonderful chance at getting the scholarship...i am number one in my cl.
